Terms of Service · Effective September 28, 2026

Fizz FM is a music app and website from HyperSocial (“we”). These terms cover the Fizz FM app, this website, and what you make with them. By using Fizz FM you agree to them, and the app may also ask you to confirm when you create an account or publish a track. If you don’t agree, please don’t use Fizz FM. Fizz FM is in beta, and these terms will change as it grows; the version on this page, with the date above, is the one that applies. Questions go to hyperjam-support@hypersocial.ai.

Who can use Fizz FM

You need to be at least 13, or older if the law where you live says so. If you’re under 18, please get a parent or guardian’s OK first. If we learn that a child under 13 has an account, we’ll delete it.

The beta

Fizz FM is in beta, offered free through Apple’s TestFlight. Beta builds expire, features change, some things will break, and things you make could be lost, so keep a copy of anything you care about (every track is plain Strudel code you can copy). Features may have limits, such as how much the composer makes for you. We may change, pause or end the beta at any time.

If you send us feedback, ideas or bug reports, through TestFlight, email or anything else, we can use them without owing you anything. If we add paid features, we’ll show you the price and any extra terms before you pay, and purchases through Apple follow Apple’s rules for payments and refunds.

Your account

You can use parts of Fizz FM as a guest. An account lets you compose, keep hearts and use features that need one. Give us accurate information, keep your sign-in secure, and tell us if you think someone else is using your account. You’re responsible for what happens under it.

You can delete your account at any time in the app’s Settings. That removes your account and your hearts from Fizz FM. Tracks on your phone stay there until you delete them. To also delete your composer history, email us. Some records may be kept for a while for security, legal reasons or backups.

What you make

The tracks, prompts and code you create are yours, to the extent anything in them can be owned. We don’t claim ownership of your music. Your tracks are saved on your phone. When you use the composer, your request and your track’s code go to our servers and to our AI providers so they can write the next version; the Privacy policy explains how.

Publishing isn’t open to everyone yet. When it is and you publish a track, you give HyperSocial a worldwide, non-exclusive, royalty-free licence to host, store, copy, play, show, adapt (for example, to trim a preview or fit a screen) and distribute it in Fizz FM and on fizz.fm, including through the providers who help us run them. You also let other people play along with it, open it, copy its code and remix it in Fizz FM.

You can unpublish a track at any time. We’ll take it off Discover and the website within a reasonable time, though it may linger in backups for a while. Remixes that other people already made stay theirs to keep.

Only publish what you have the right to share. Don’t upload or recreate recordings, samples or lyrics that belong to someone else without permission.

Our tracks and the sounds inside yours

The tracks Fizz FM publishes belong to us or their creators. You’re welcome to play them, remix them and keep your remixes in Fizz FM; ask us before releasing one outside Fizz FM. Fizz FM’s instruments and samples come from open-source sound libraries with their own licences, so check those before you release music commercially.

AI-made music

Fizz FM’s composer uses AI models to turn what you ask for into Strudel code. Asking for a genre, a mood or a style is fine. Don’t use it to copy a specific recording, melody or lyrics. AI-made parts of a track may not be protected by copyright, and similar requests can get similar results, so we can’t promise you own them or that no one else has something like them. The composer’s results come with no guarantee; check them before you rely on them. Please don’t put personal or sensitive information in prompts.

Acceptable use

Display names and track names follow these rules too. We don’t tolerate objectionable content or abusive users. You can report a track or a person to hyperjam-support@hypersocial.ai; we review reports promptly and may remove content, hide it, or suspend accounts. We don’t check everything before it appears, and we aren’t responsible for what other people publish.

If someone uses your work

If you think something on Fizz FM infringes your copyright, email hyperjam-support@hypersocial.ai with: the work; where it appears on Fizz FM; your contact details; a statement that you believe in good faith the use isn’t authorised; a statement that your notice is accurate and that you own the work or may act for its owner; and your name as a signature. If we remove your track and you think we got it wrong, reply and tell us why. We close the accounts of people who infringe again and again.

Open source and other services

Fizz FM is built on Strudel and other open-source software, under licences such as the GNU AGPL. Nothing in these terms limits your rights under those licences; Strudel’s source is at codeberg.org/uzu/strudel. Videos on this website belong to their creators and play from YouTube under YouTube’s terms. Sign in with Apple or Google, and TestFlight, are covered by those companies’ terms, and we aren’t responsible for third-party services.

If you got Fizz FM from Apple

These terms are between you and HyperSocial, not Apple, and Apple isn’t responsible for Fizz FM or its content. You may use the app on Apple devices you own or control, as Apple’s Usage Rules allow, and the licence can’t be transferred. Apple has no duty to support the app. If the app fails a warranty that applies by law, you can tell Apple, and Apple will refund the price you paid, if any; beyond that, Apple has no warranty duty. HyperSocial, not Apple, handles any claim about the app, including product liability, failing a legal or regulatory requirement, consumer protection or privacy, and claims that the app infringes someone’s intellectual property. You confirm you aren’t in a country under a U.S. government embargo and aren’t on a U.S. list of prohibited or restricted parties. You must follow any third-party terms that apply when you use the app. Apple and its subsidiaries can enforce these terms against you.

Ending things

You can stop using Fizz FM and delete your account whenever you like. We may suspend or close accounts that break these terms, or end the service, and we’ll try to give notice when we reasonably can. The parts of these terms that should naturally last, like the licences for tracks others already remixed, the feedback licence and “No guarantees”, keep applying after your account ends.

No guarantees

Fizz FM is provided as it is, while we build it. To the extent the law allows, we don’t promise it will always be available, error-free or fit for a particular purpose, and we aren’t liable for lost tracks, data or profits. Nothing in these terms limits rights you have under the law where you live that can’t be limited.

Changes and the legal bits

We’ll update these terms as Fizz FM grows and change the date above when we do. If a change matters, we’ll tell you in the app or by email before it takes effect, unless it’s needed sooner for legal or safety reasons. If you keep using Fizz FM after that, the new terms apply; if you don’t agree, you can stop and delete your account.

These terms and the Privacy policy are the whole agreement between us about Fizz FM. If part of them can’t be enforced, the rest still applies, and if we don’t enforce something right away we haven’t given up the right to. You can’t transfer these terms; we may if Fizz FM changes hands. We’ll send notices to your account email or show them in the app. Send yours to hyperjam-support@hypersocial.ai.
